In 2016, Feldman, Kleidman, Coffey & Sappe LLP’s (FKC&S) 57-year-old client (plaintiff) was injured as a result of a rear-end collision in Dutchess County, NY, on Route 9 near the Poughkeepsie Galleria. While stopped, the plaintiff’s vehicle was struck from behind by a vehicle driven by the defendant. In opposition to FKC&S’s motion for summary judgment, the defendant argued that the accident was due to the plaintiff making a sudden stop. Steven H. Cohen successfully argued that the defendant’s sworn statement – that she observed the traffic light was red prior to the plaintiff’s vehicle coming to a stop – belied her contention that the plaintiff made an unexpected stop. The court agreed with Mr. Cohen and found that the defendant’s negligence caused the accident. Mr. Cohen successfully obtained summary judgment on the issue of liability and in dismissing defendant’s affirmative defense of contributory negligence.
