
In January 2022, Feldman, Kleidman, Collins & Sappe LLP’s (FKC&S) client, a 64-year-old plumber from Sullivan County, NY, was called to look at a burst pipe in the basement of a condo in Liberty. Unbeknownst to him, the base of the wooden stairs leading down to the basement had been cut in anticipation of a concrete floor being poured. As he descended the stairs, they gave way and he fell, suffering a fractured heel. He was out of work for a few months.
The case was placed into suit against the owner of the property and the property manager. During depositions, there was conflicting testimony as to who directed that the stairs be cut. The case was settled for $290,000 during mediation, with both defendants contributing to the settlement.
