Ron Ball recently obtained a defense verdict after a two week trial in Westchester Supreme Court on behalf of a neurologist. Plaintiff claimed that our client should have referred him to a neurosurgeon sooner, because of his symptoms of radiating pain in his left leg, left foot drop and an MRI reported as showing a left-sided herniated disk at L3-4. Plaintiff also sued a prior treating chiropractor alleging that he should have referred him to a neurologist or neurosurgeon before the plaintiff went to our client. After treating the patient conservatively with prednisone, repeating the MRI and working him up for positive Lyme titer and positive Lyme IgG, our client referred plaintiff to a neurosurgeon 12 days after the first visit. The neurosurgeon performed a discectomy at L3-4. While the surgery alleviated the plaintiff’s pain, his drop foot remained. Plaintiff’s expert neurosurgeon testified that earlier referral by our client and surgery would have improved the plaintiff’s outcome. We called a board certified neurologist and a board certified neurosurgeon as experts on behalf of our client who explained the reasonable nature and reasons for our client’s workup of the patient. After one hour of deliberation, the jury unanimously found that our client’s care and treatment did not cause the plaintiff’s claimed injuries.
