J. Peter Collins, attorney at law, recently successfully defended a Poughkeepsie facial reconstruction surgeon in a Rockland County lawsuit. The plaintiff claimed that our client was negligent in the surgery that was performed to reconstruct her nose following Mohs surgery to remove extensive basil cell carcinoma. She also claimed that she did not consent to the surgery performed and suffered unnecessary and significant scarring as a result. It was alleged that our client should have performed a different surgical reconstructive procedure. The jury agreed that our client was well within the standards of care in his selection of the appropriate surgical procedure to address the cancer-related defect and that he properly performed the procedure. The jury also agreed that plaintiff had consented to the procedure that was performed.
