$400,000 settlement for commuter who slipped and fell on ice at a train station

A 54 year old commuter coming home from work slipped and fell on a dangerous black ice formation in a train station parking lot and sustained a tri-malleolar fracture of her ankle which required multiple surgeries. FKC&S sued the railroad and the contractors it hired to plow and maintain the parking lot. Exhaustive investigation and discovery revealed that the railroad’s contractors piled the plowed snow in an uphill location in the lot where it would melt and cause water runoff downhill across the parking lot. This resulted in the runoff water freezing after dark and creating a sheet of very slippery black ice which had not been salted or sanded by the railroad contractors after it froze. FKC&S negotiated a $400,000 settlement prior to trial for the injured commuter.
