At approximately 11:00 p.m. on October 2, 2020, Feldman, Kleidman, Coffey & Sappe LLP’s (FKC&S) 24-year-old client from Staatsburg, NY finished work, had a few beers and was crossing Washington Street in Poughkeepsie on foot. The defendant was speeding southbound on Washington Street, did not have his headlights on and was not paying attention when he struck our client, who dove to get out of the way. As a result, he sustained multiple fractures and tears to his right leg, requiring surgery. The defendant argued our client was intoxicated and the crash was his fault. The case was placed into suit and after our client testified at his deposition, the carrier offered all of the available insurance to settle the case.
